3 infants were observed to be sitting in wooden chairs and were not strapped in. NOTE: The wooden chairs were designed with straps. The straps appeared to be worn and were knotted.

Operational policies were reviewed the following were still observed to be missing: 1. Days, hours, and months of operation 4. Immunization requirements for children, including tuberculosis screening and testing if required by your regional Texas Department of State Health Services or local health authority 5. Hearing and vision screening requirements 6. Promotion of indoor and outdoor physical activity that is consistent with Subchapter F of this chapter (relating to Developmental Activities and Activity Plan). Your policies must include: (A) The benefits of physical activity and outdoor play (B) The duration of physical activity at your operation, both indoor and outdoor (C) The type of physical activity (structured and unstructured) that children may engage in at your operation (D) Each setting in which your physical activity program will take place(E) The recommended clothing and footwear that will allow a child to participate freely and safely in physical activities(F) The criteria you will use to determine when extreme weather conditions pose a significant health risk that prohibits or limits outdoor play (G) A plan to ensure physical activity occurs on days when extreme weather conditions prohibit or limit outdoor play. 8. Instructions on how a parent may access :(A) Minimum standards online; (B) Texas Abuse and Neglect Hotline; and (C) HHSC website. 9. Preventing and responding to abuse and neglect of children, including: (A) Required annual training for employees (B) Methods for increasing employee and parent awareness of issues regarding child abuse and neglect, including warning signs that a child may be a victim of abuse or neglect and factors indicating a child is at risk for abuse or neglect (C) Methods for increasing employee and parent awareness of prevention techniques for child abuse and neglect (D) Strategies for coordination between the center and appropriate community organizations (E) Actions that the parent of a child who is a victim of abuse or neglect should take to obtain assistance and intervention, including procedures for reporting child abuse or neglect 10. Information on vaccine-preventable diseases for employees, unless your center is in the home of the permit holder. The policy must address the requirements outlined in ?746.3611 of this chapter (relating to What must a policy for protecting children from vaccine-preventable diseases include?) 11. Procedures for supporting inclusive services to children with special care needs. The policy must address the requirements outlined in ?746.2202 of this chapter (relating to What are my responsibilities when planning activities for a child in care with special care needs?)

Use zone for a slide and track ride were observed to be overlapping.

Upon arrival, two children were observed to be eating breakfast and watching TV. NOTE: The TV was turned off by the caregiver in charge.

Two Rock N' Play sleepers recalled 1/9/2023 were observed at the operation. One of which was in use by a 3mo child in care. NOTE: Operation completed the children's product safety certification 9/6/24. Both sleepers were removed during the inspection.

An extra mattress pad was observed inside one of the play yard. The warning label states not to use extra padding in the play yard. Note: Pictures were taken for the file. No infants were in the play yard at the time of the inspection. The padding was removed during my inspection.

The training certificate showing the director has completed the required training topics was not available for review.

The feeding instructions for 2 infants have not been signed by parents within the last 30 days.

4 out of 5 staff records evaluated did not contain the following training topics: Emergency Preparedness Responding to Food Allergies Handling Storing and Disposing of Hazardous Materials Understanding Building and Physical Premises Safety Preventing The Spread of Communicable Diseases

During the inspection an infant was observed sleeping with a pacifier attached to their clothing. Note: The provider corrected this during the inspecton by removing the pacifier attachment.

1 out of 5 children's files evaluated were missing immunizations.

A review of the Employees Who Left Employment in 2021data from February 23, 2022, revealed that the center had not reported the number of employees who left employment in 2021by February 22, 2022, as required.

Operation did not notify licensing on their first case of communicable illness.

There were three torn sleeping mats found in the classroom. They were removed and replaced with the names of the children written on them.

Immunization information was missing on one out of eight files checked.

Release information was missing on one out of eight files checked.

One infant was not signed in during inspection. Director stated that the mom works in the day care. This was corrected duirng inspection when child was signed in.

Fire inspection had expired since 7/15/2021.

Based on DFPS investigation and observation in the operation she observed 3 infants asleep in restrictive devices. This was a plan cite deficiency.
